Terms of Service

1. Agreement

These Terms of Service ("Terms") are a binding agreement between you and BigSteppa ("BigSteppa," "we," "us," or "our") governing the BigSteppa iOS app, website, invite links, and related services (the "Services"). By using the Services, you agree to these Terms and our Privacy Policy.

2. Eligibility

You must be at least 18 years old, legally capable of entering a contract, and permitted to use the Services where you live. You are responsible for determining whether participating in a rivalry or using money features is lawful in your jurisdiction. Do not use a wager or settlement feature where prohibited.

3. Accounts

You must provide accurate information, maintain control of your phone number and devices, and promptly report unauthorized access. You are responsible for activity performed through your account. We may use one-time codes to authenticate you.

4. Health Data and Check-Ins

BigSteppa reads step counts from Apple HealthKit only with your permission. The Services are not a medical device and do not provide medical advice. Step totals can be incomplete or inaccurate because of device behavior, permissions, timezone changes, synchronization delays, manual Health entries, or third-party systems.

You choose when to submit a check-in. Unless a specific rivalry states otherwise, check-ins report the previous local calendar day's steps using the device timezone at query time. You may not falsify, manipulate, or submit another person's activity.

5. Rivalry Rules

Each rivalry is between two users and has a daily step goal and wager. A rivalry created through an invite starts on the next day in the creator's timezone.

• If both rivals meet the goal or both miss the goal, neither rival wins that day.
• If exactly one rival meets the goal, that rival wins the daily wager.
• If only one rival checks in by the deadline, the rival who checked in wins even if that rival did not meet the goal.
• If neither rival checks in, neither rival wins.

The app's recorded result controls unless we determine that a technical error, fraud, or abuse requires correction. Rivalry history, streaks, and balances may change when delayed data is reconciled.

6. Funding and Settlement

Money features may be unavailable, limited to test users, or disabled. Where enabled, dollar-denominated account balances and rivalry settlements may be facilitated using USDC on the Base blockchain through third-party embedded-account, wallet, and onramp providers.

USDC is not a bank deposit and is not insured by the FDIC or any government agency. Digital assets and blockchain systems involve risks, including loss of value, smart-contract failures, network delays, irreversible transfers, third-party outages, and changing regulation.

By enabling money features and joining a funded rivalry, you authorize the Services and their providers to initiate the transfers needed to settle valid rivalry results, including automatic settlement after a missed check-in. BigSteppa may sponsor network fees but is not required to do so.

If your available balance is insufficient, the unpaid amount may be recorded as an outstanding obligation to your rival. We may prompt you to fund your account and may retry settlement after funds become available. You remain responsible for valid obligations shown in the Services.

Onramp and embedded-account providers may impose separate terms, identity checks, limits, fees, and availability rules. You are responsible for taxes arising from rivalries, rewards, transfers, or digital assets.

7. Acceptable Use

You may not use the Services to break the law; harass or defraud another person; manipulate Health or rivalry data; launder money; evade sanctions; probe or disrupt the Services; access another account; or automate use without permission. We may investigate, limit, suspend, reverse an internal record, or terminate access when reasonably necessary to protect users or the Services.

8. Third-Party Services

The Services depend on third parties, including Apple HealthKit, phone-verification providers, cloud hosts, embedded-account providers, onramps, blockchain networks, and RPC services. Their services and terms are outside our control. BigSteppa is not responsible for third-party downtime, acts, omissions, or changes.

9. Ownership and Feedback

BigSteppa and its software, branding, and content are owned by us or our licensors and are protected by law. We grant you a personal, limited, revocable, non-transferable license to use the Services. If you submit feedback, you grant us permission to use it without restriction or compensation.

10. Suspension and Termination

You may stop using the Services at any time. We may suspend or terminate access for violations, legal or security risk, discontinued features, or prolonged inactivity. Termination does not erase valid outstanding obligations or records we must retain.

11. Disclaimers

To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted operation, accurate step data, successful funding or settlement, a stable USDC value, or any particular rivalry outcome.

12. Limitation of Liability

To the maximum extent permitted by law, BigSteppa and its affiliates, officers, employees, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or digital assets. Our total liability relating to the Services will not exceed the greater of $100 or the amount you paid directly to BigSteppa during the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold BigSteppa harmless from claims, losses, and expenses arising from your unlawful use of the Services, violation of these Terms, fraud, manipulation, or infringement of another person's rights.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Courts with jurisdiction in California will have exclusive jurisdiction, except where applicable consumer law requires otherwise.

15. Changes

We may update these Terms as the Services evolve. We will post updated Terms and revise the effective date. Continued use after an update takes effect constitutes acceptance where permitted by law.
